Warranty

We are primarily first and foremost dedicated to our clients’ 100% satisfaction with their newly crafted wide plank floors. We bring more combined experience in crafting your wide plank floors than anyone else in the industry.

Limited Structural Warranty

Engineered or Solid Plank Flooring

The limited warranties described in this Warranty are given only to the original purchaser of our floors. We warrant you the purchaser that for the lifetime of your floor, the William and Henry floor will be free from defects in milling, dimension, assembly and grade. Engineered flooring will not delaminate and will remain solid for the life of your floor. Inspection of your floors is critical upon receipt of shipment as this warranty will not cover any flooring containing defects after the installation.

The Longevity of the floor. We warrant that the William and Henry floor, either solid or engineered, may be sanded and refinished at least 3 times without changing the overall look your floor. As long as proper techniques are used by a professional that is familiar with the National Wood Flooring guidelines. Allowing many years of use that make William & Henry floors a sound investment.

Purchaser’s Responsibilities

All flooring needs to be inspected and carefully looked over for any milling or visual defects prior to installation. The installer must use reasonable selectivity and hold out or cut off pieces with defects. If any flooring is installed prior to the instructions below, the warranty is void.

You and your installer are responsible for acclimating and installing the floors in the proper environment. We recommend a climate temperature of 60-75 degrees Fahrenheit and a relative humidity level of 35-55%.

The flooring needs to be installed within accordance of prevailing industry standards set by the NWFA guidelines. In the event of filing a claim you will be responsible for proof of proper care and installation of the flooring. We recommend you have record of pre-installation moisture tests, as well as documentation of adhesives and maintenance.

Warranty Process

If you the original purchaser, believe that the flooring you purchased does not conform to the warranties described in this Warranty, you must submit a claim to us in writing within a couple weeks of receipt of your floor. Your claim must be accompanied by your sales slip and , if you are asserting a claim under the structural Warranty pertaining to delamination or refinishing, you must submit proof of proper installation practices. ( moisture tests and adhesives ) and maintenance.

Responsibilities If a Covered Event Occurs

If any of the William & Henry does not meet the standards, we will make every attempt to fix either by providing more stain or finish or repairing the defective flooring at our option. In the unlikely event that then new flooring or finish fails to meet our warranty standards after a reasonable number of attempts, we will refund the portion of the purchase price for the finish of the failed flooring. Our warranty only covers our product and does not include any additional costs for the repairs or replacement.

Warranty Limitations

The warranties described in this Warranty do not cover certain events beyond our control. The following is a list of limitations to our warranties not otherwise described in this Warranty. When specific examples are itemized, they are intended to be illustrative of general category of limitations and are not intended to be exclusive.

Our warranties do not cover:

  • Conditions caused by improper use or maintenance, such as: scuff marks, scratches, reduction in gloss, gauges, or dents
  • Damage caused by negligence, accidents or abuse
  • Wear caused by dirt, sand, or other abrasives or failure to maintain the floor as required
  • Grain raising, splits, cracks, checking, edge fracturing, splintering that occurs during or after floor has been installed and as a result of misuse, abuse, improper care, or exposure to excessive moisture or an improper environment. Low or High Humidity
  • Natural expansion and contraction resulting in gaps between flooring, to include, cupping or crowning caused by changes in relative humidity and temperature during or after the installation process
  • Changes in color due to aging, sunlight or excessive moisture
  • Color or texture variations between samples, replacement flooring
  • Natural wood characteristics such as variations in grain, color, knots or other natural occurrences from the life of the tree
  • Normal wearing of finish in high traffic areas and seating areas
  • Noises including squeaks, popping, etc.
  • Deficiencies related to subfloor/floor joists assemblies, subfloor preparation materials
  • Floors damaged by water or subfloor moisture, including without limitation, due to broken or leaking water pipes, flooding, wet mopping, or any natural weather conditions
  • Damage caused by fire, flooding, or other natural disasters

Please Note—you and your installer are responsible for inspecting flooring prior to installation. We accept no responsibility for flooring with defects after it has been installed.

Warranty Exclusions and Disclaimer

We exclude and will not be liable for or pay under the warranties in this Warranty, any and all incidental, consequential, punitive or special damages. By this, we mean any loss, expense, or damage other than to the flooring itself that may result from a defect in the flooring. For example, these warranties do not include the removal or replacement of cabinets, fixtures, retail markups, installation or labor provided by others or supplemental costs, including but not limited to, relocation during the repair process such as a hotel, meals, or moving and storage of furniture. Our limited warranties constitute the only express or implied warranties for the product purchased.

Disclaimer:

To the extent permitted by law, all warranties other than our limited warranties described in this warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, are disclaimed. If any implied warranty arises under state law and cannot be disclaimed, then any such implied warranties are limited in duration to the duration of the written warranty, to the extent allow by law.

Acceptance

You must inspect the products at the time of delivery and notify the carrier immediately of any damage, which should be noted on the bill of lading; otherwise the shipment will be deemed to have been accepted.

Site Conditions and Installation

You are responsible for ensuring proper site and storage conditions to avoid damage to the William & Henry Flooring. William & Henry Wide Plank Flooring expressly disclaims and responsibility for problems due to site and storage conditions, improper installation and or improper acclimation for the relevant conditions.

Conflicting Documents or Terms

These terms and conditions apply to this purchase and may not be modified or amended except in writing by William & Henry Wide Plank floors. Any additional or contrary terms proposed by you or contained in any other documentation are expressly rejected. As a manufacturer and supplier, William & Henry Wide Plank floors is not subject to or bound by any construction contracts or agreements relating to the installation of the flooring.

Governing Law

Your purchase and these terms and conditions will be governed solely by the laws of the state of New Hampshire without application of conflict of laws principles.

Jurisdiction / Venue

Each party irrevocably submits the exclusive personal jurisdiction of the courts of the state of New Hampshire and the venue for the courts in Cheshire County, NHEach party agrees that the New Hampshire, Cheshire County courts shall be the exclusive jurisdiction and venue of any litigation or special proceeding to resolve any dispute or claim arising from or related to our connected with this contract, including any claims based on statute, common law or ruleThe parties hereby waive any objection to such forum based upon venue . 

Attorney’s Fees

In connection with any litigation arising out of this agreement, the prevailing party shall be entitled to recover from the other party its attorney’s fees and costs, including attorney’s fees and costs for any appellate proceedings.
